Ask a Cop?: Does this count as an assault?

Question:

I deliver pizzas. Sometimes people will prank us with silly string or other harmless things. Which is usually all fun and games. But I have hearing aids. If someone were to throw water on me or any liquid that would damage them, which they had cost $7,000, would I be able to count that as assault or make them pay for replacements?

Answer:

Technically, throwing water or anything at someone can be considered an assault. If hearing aides got ruined because someone threw water on you I’d think a lawsuit could be successful, as long as you report it right away to your boss and call the PD for an incident report for evidence. If it’s raining at the time though might be hard to prove rain didnt cause damage to the hearing aides.. I wouldnt call the PD for silly string or something that didnt cause loss or pain, but if your hurt or it caused damage, I would. If someone sprayed silly string or threw water at me during a delivery I would drop their pizza on the ground and say “so sorry, you startled me”, then I’d turn and walk away. I’d also have my boss blacklist the address and not deliver there anymore. You can also wear a body camera when making deliveries. They’re pretty cheap nowadays and simply clip onto your shirt. Then you’d have video of anything that happens during deliveries including assaults or robberies. I’m suddenly craving pizza…
