We had a new employee abandon their job and be fired they are in possession of the company’s cellphone and keys? how do we go about getting them back.

Answer:

This is in the end is a civil matter and less about anything law enforcement can do. Here is a good link with info related to how best to setup employe use of company equipment and what needs to be done to get it back. If they are unresponsive to requests a lawyer will need to draw up the paperwork to file against them for the return of the company property.

Just an important note – Not many if any states allow for pay to be withheld till the items are returned thou I know of many that have used that. It can get you into major trouble.

In some cases and depending on the overall reasons behind the reason the person became an X employee, it might also be an option to just take it as a company loss and avoid more issues with the employee.
